General Rental Terms and Conditions

GENERAL RENTAL AND VEHICLE DELIVERY TERMS AND CONDITIONS

In order for the vehicle rental transaction to be legally established and for the vehicle to be delivered to you, the Vehicle Rental Agreement and the Vehicle Delivery Form, which documents the vehicle's specifications, rental price and duration, fuel and possible damage situations, must be signed by both parties.

We provide our users with detailed information regarding their responsibilities under the contract both in our company offices and on our website at www.mnetrip.com .

We would like to remind you to carefully read the General Rental and Delivery Conditions on this page before completing your vehicle rental transaction. You acknowledge that failure to sign the Vehicle Delivery Form upon delivery or return shall constitute acceptance of its contents. Should you have any objections to the Form, you agree to arrange for an expert assessment at your own expense. Failure to do so shall result in your objections not being considered.

YOUR RESPONSIBILITIES

The vehicle, its accessories and keys are your responsibility. For the duration of the rental agreement, you must use the rented vehicle in accordance with the Highway Traffic Act No. 2918 dated 13 October 1983 and Traffic Regulations No. 26901. 
- It is your responsibility to use the vehicle in accordance with road and weather conditions and speed limits. You are responsible for any damage caused by using the vehicle beyond its capacity and intended purpose, hitting bumps and potholes, using it off-road or on sand, and any damage caused by water entering the engine or other parts of the vehicle. You must not use the vehicle for racing, speeding, testing the vehicle's durability and speed, or teaching someone else to drive. 
- Keep the vehicle locked when not in use. Ensure you are using the correct and appropriate fuel. Check oil levels and maintain tyre pressures at the required levels.
- Even if you have returned the vehicle, you remain liable for any offences, parking fines, traffic fines, or unauthorised OGS and HGS toll crossings that may arise in relation to the period during which the vehicle was in your possession. In addition, you are obliged to provide all requested information about yourself and any additional drivers accompanying you upon request. If you fail to provide this information completely and accurately, all responsibility lies with you. Even free of charge, you may not allow the vehicle to be used by anyone other than the names listed in the contract. You may not grant legal rights to the vehicle to any person and may not transfer your own rights.
- Under no circumstances should you top up the brake, clutch, gearbox oil or engine coolant fluid levels for your own safety. If any warning lights come on on the dashboard or low fluid levels are detected, contact us immediately. In case of emergency, the telephone number you can reach 24 hours a day will be provided to you by the office representative who delivered the vehicle.
- Should you notice any malfunction with the vehicle, you must notify us immediately. Do not allow anyone to work on the vehicle without written permission. If you are unable to check the condition of the vehicle yourself, or if we have agreed that you will return the vehicle outside of working hours, you will be deemed to have accepted in advance the inspection to be carried out by our authorised representative or employee, and you will be liable for any damage incurred during the period until the condition is determined. If you object to this determination, you may request an expert inspection, provided you cover the costs.
- Any expenses incurred by us to restore the vehicle to its pre-rental condition due to modifications made to the vehicle without our approval, damages not recorded in the report upon return of the vehicle and/or reported with incomplete documentation, and damage costs not covered by insurance/exceeding the insurance coverage limit, damage to the vehicle's interior trim, - The vehicle may only be used by you, by the additional driver specified in the contract, or by persons authorised in writing by us. The person using the vehicle must have a valid driving licence.
- You may not use the vehicle while under the influence of alcohol and/or drugs. You may not carry more passengers than the vehicle's capacity allows and may not leave Montenegro without an Agreement.
- Before returning the vehicle, please check whether you have any personal belongings left inside. Unfortunately, we cannot accept responsibility for any personal items left behind in the vehicle.

FEES

The fees for which you are responsible are as follows:

- Any rental and one-way fees, navigation fees, child seat fees, etc. specified on this website or on the vehicle delivery form,
The total amount of fees, damages, losses, expenses, costs or liabilities incurred due to failure to comply with the rules specified in the Your Responsibilities section,
- You will collect the vehicle from our offices with a full fuel tank. If you return the vehicle with less fuel than when you picked it up, you will be charged for the difference in fuel between the level specified on the vehicle delivery form and the level when returned, plus a 25% service charge. - All tolls (bridge, motorway, ferry, etc.), waiting compensation, traffic fines, speeding fines, court costs that may arise due to parking or other traffic offences (including costs that may arise due to the vehicle being towed and/or impounded) and damages incurred in the event of the vehicle being confiscated.
- Any tolls, fines or costs incurred on your behalf, plus a service charge of €20 per payment,
- All repair costs for damage not specified on the Vehicle Delivery Form and not recorded in the police report at the end of the rental period,
- The repair costs for damage not covered by insurance due to user error, repair costs for damages not covered by insurance, and fees for days when we cannot rent out the vehicle due to damages not covered by insurance (charged at the standard daily rental rate).
- Damages that may arise due to the vehicle being impounded by law enforcement for any reason and fees for days when we cannot rent out the vehicle.
- Fees that may arise for delivering and collecting the vehicle outside the city limits where our relevant office is located. - A late payment penalty of 5% per month will be applied for late payment of your debt, and this rate will be adjusted according to the Central Bank's monthly credit interest rates based on current conditions. VAT will be added to the above-mentioned fees.

INSURANCE - LIABILITY LIMITS

- By signing the Vehicle Delivery Form, you agree to our insurance terms and conditions. Unless otherwise stated, the insurance terms and conditions set out in this information notice shall apply. Should a separate insurance policy be applicable, we will share information regarding the scope of this insurance and the necessary conditions in this section.

The vehicle you are renting is covered against collision, impact, theft and attempted theft. Damage that may be caused to third parties is also covered within the limits of the motor insurance. Our insurance terms and conditions do not include any damage exemption. However, the costs of damages that are not properly documented (accident report, alcohol report, documents of the parties involved in the accident, etc.) are solely the responsibility of the user. In the case of undocumented damages, the damage repair process will not be carried out based solely on the driver's statement.

- The accident must have occurred while the vehicle was being used by one of the persons named in the vehicle contract,
- No alcohol must have been consumed and/or no drugs must have been taken during the use of the vehicle,
- In the event of a SINGLE-VEHICLE accident or theft, the vehicle must be taken to the nearest police or gendarmerie station without moving it from the scene.
- In TWO-VEHICLE accidents, except in the circumstances specified in the following paragraphs, the Material Damage Accident Report must be completed as indicated on the report form, depending on the circumstances of the accident. In two-vehicle accidents, the traffic accident report must be completed by the traffic police only in the following circumstances: If the driver is operating a motor vehicle without a driving licence.
If the driver is underage,
if there is suspicion of alcohol or mental health issues in the driver,
if one of the vehicles involved in the accident belongs to a public institution,
if damage occurs to property belonging to a public institution, 
If only property belonging to third parties is damaged in the traffic accident,
If one of the vehicles involved in the accident has traffic insurance,
If the traffic accident resulted in death and/or bodily injury,
- In the event of THEFT, a "Theft Report" must be obtained from the nearest police or gendarmerie station, and the keys and vehicle registration must be delivered to our company.
Any damage exceeding the insurance coverage limits is the responsibility of our users.

PRIVACY

We will not share any information you have provided to us for this rental with third parties for commercial purposes; we attach the utmost importance to your personal privacy. You agree that we may use the information you have shared to take reservations, add you to our customer list, receive payment, and investigate any follow-up issues that may arise while the vehicle is in your use and after its return, in accordance with the terms specified in the rental agreement. We may also use the information you have provided to us for statistical and market research purposes. If you act contrary to the terms of the rental agreement, we may record this for use in making future decisions about you. We may share this information with credit rating agencies, the police, institutions to which you owe money, other organisations that will decide whether to accept you as a customer based on information about you, and the Association of All Car Rental Companies (TOKKDER). You agree that we may collect information about your car rental history from other organisations when deciding whether to provide you with a vehicle. You agree that we may disclose the information of you and any additional drivers mentioned in this rental agreement to public authorities and courts upon request.

TERMINATION OF THE AGREEMENT

If the rental fees are not paid on time, the contract shall be terminated unilaterally without any notice or warning. In this case, the vehicle must be returned to our company immediately. If the vehicle is not returned, the renter shall be deemed to have committed the offence of breach of trust. The unilateral termination of the contract by us shall not prevent us from collecting any debts arising from the contract. If you fail to fulfil the main obligations of the contract, we may charge additional fees to cover the damages, losses and loss of income we have incurred, based on our rights arising from the contract and the law.

CANCELLATIONS

You may cancel your rental free of charge up to 48 hours before the time you are due to collect the vehicle. If the rental is cancelled less than 48 hours before the rental period begins, or if the vehicle cannot be delivered to you due to non-compliance with the rental terms, the daily rental fee for the reserved vehicle will not be refunded. During peak reservation periods (15 June to 15 September and public holidays), free reservation cancellation will end 24 hours before the rental, and the 1-day rental fee will not be refunded.

Our company reserves the right to cancel reservations made via the website with 12 (twelve) hours' notice; in such cases, any fees you have paid will be refunded to you.
